Terms of Service

1. Agreement to Terms

By accessing or using the Statura platform ("Service"), operated by Statura Care Pty Ltd (ABN pending) ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Statura is a cloud-based aged care compliance management platform designed for Australian aged care providers. The Service provides tools for compliance tracking, workforce management, clinical care documentation, quality indicator reporting, and related functions under the Aged Care Act 2024.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorised use.

4. Free Trial

New organisations may receive a 14-day free trial. During the trial, all features are available. At the end of the trial, you must subscribe to a paid plan to continue using the Service. We may modify or discontinue trial offers at any time.

5. Subscription and Payment

Paid subscriptions are billed monthly or annually via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis. Prices are in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

6. Your Data

You retain ownership of all data you submit to the Service ("Your Data"). You grant us a limited licence to host, process, and display Your Data solely to provide the Service. We will not sell, share, or use Your Data for any purpose other than operating the Service.

You are responsible for ensuring that Your Data complies with all applicable laws, including the Privacy Act 1988 (Cth) and the Aged Care Act 2024.

7. Data Security

We implement industry-standard security measures including AES-256-GCM encryption for sensitive fields, TLS encryption in transit, row-level security, and audit logging with hash chain integrity verification. However, no system is completely secure, and we cannot guarantee absolute security of Your Data.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or its systems
  • Interfere with or disrupt the Service
  • Reverse-engineer, decompile, or disassemble the Service
  • Use the Service to store or transmit malicious code
  • Share your account credentials with unauthorised parties

9. Limitation of Liability

The Service is provided as a compliance management tool and does not constitute legal, medical, or regulatory advice. You remain solely responsible for your organisation's compliance obligations.

To the maximum extent permitted by law, our total liability for any claim arising from or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Availability

We aim to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. Emergency maintenance may be performed without notice.

11. Termination

We may suspend or terminate your access if you breach these Terms. You may terminate your account at any time. Upon termination, we will retain Your Data for 30 days, after which it will be permanently deleted.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
